INTERNATIONAL AGREEMENT
ON THE REPRESSION OF TERRORIST FUNDS


As part of the fight against terrorism, the Principality of Monaco has become part of the International Agreement for the Repression of Terrorist Funds. The signature was made November 10, 2001 by H.S.H. Crown Prince Albert through the General Secretary of the United Nations.

The agreement was adopted by resolution 54/109 on December 9, 1999 at the 54th session of the UN General Assembly.
13 countries are currently part of the international text.

The agreement applies to an infraction committed by any person who, either directly or indirectly, illicitly and deliberately, supplies or collects funds with the intention of seeing them used or knowing that they will be used, either wholly or partly, to commit one of the acts listed in the annex of the Agreement or an act destined to kill or seriously injure a person who is not directly involved in armed conflict, with the goal of intimidating a population or forcing a government or an international organization to take action or refrain from taking action. The act of supplying or collecting funds with this purpose is an infraction, regardless of whether the funds were or were not eventually used to commit one of these acts. The Agreement does not apply when an act of this nature does not include any international element.

The arrangements of the Agreement require that State Parties take all necessary measures to detect, freeze, seize or confiscate funds used or intended for infractions. The infractions envisioned by the Agreement are considered as a case of extradition and the State Parties have the obligation to establish their understanding concerning these infractions, to punish them appropriately, to detain, pursue or extradite those accused of committing the acts, to cooperate with preventative measures and counter-measures and to exchange information and proof necessary for the penal procedure. The infractions envisioned by the Agreement are considered as a case of extradition among the State Parties by virtue of the treaties established between these States and by virtue of the Agreement itself
